DUI and Employment

Getting arrested for a DUI is a difficult experience to begin with, but if you’re worried your employment status, it can cause a lot more stress.

What if a potential employer does a background check and sees you have a criminal history?

It’s very important to understand that laws regarding employee background checks vary from state to state. A local DUI attorney has the most knowledge about potential obstacles you may face, so it’s important to speak with a drunk driving defense attorney as soon as you can. Additionally, you can also check with your state’s Department of Labor.

Sometimes a background check will only go back a couple of years. Other times, a criminal record will be reported no matter how many years ago it occurred. It all depends on the job. For example, a job that involves driving will look into your driving records. Jobs that involve teaching, nursing or medicine will take a closer look at your criminal history and your DUI conviction will be reported.

Here’s the good news:

If you were arrested for a DUI and you didn’t plead guilty and were NOT convicted of a DUI, it won’t be reported on a background check.

However, if you are convicted, it will likely be reported. Additionally, if you have yet to appear in court, your DUI arrest can appear on your background check. Again, it all depends on your state and the type of job you are applying for.

Above all, if you want to improve your chances of your employer or potential employer finding out about your DUI, it is of the utmost importance to hire an experienced DUI attorney as soon as you can.

Bobby Brown Arrested for 2nd DUI in Los Angeles County

Bobby Brown DUI

Just seven months after his first arrest, singer Bobby Brown has been arrested for another drunk driving offense in Tarzana, CA. The ex-husband of late singer, Whitney Houston, was driving near his home when he was pulled over for a traffic violation. Police suspected that alcohol was in his system and proceeded to give Brown a breathalyzer test and a field sobriety test. He failed both.

Brown was taken into custody and was released within a couple of hours.

Because this is his second DUI within a short amount of time, Brown will likely face severe consequences if convicted.

Hall of Famer Arrested for DUI in a Cornfield

Carlton Fisk, an MLB Hall of Famer, was arrested for a DUI in New Lenox, Illinois yesterday. The consequences for a DUI conviction in the Chicago area can include loss of driver’s license and potential jail time.

Early this morning, New Lenox police were notified of a truck that drove into the middle of a cornfield. When they arrived, they found Fisk to be passed out at the wheel. He refused a BAC test and his truck ended up getting impounded. Carlton Fisk was taken to the hospital for a checkup and has since been released.

Refusing to take a BAC test can be a risky move because you can get your license automatically suspended without any opportunity of applying for a restricted license or an ignition interlock device.

Above all, an automatic license suspension and other consequences depend on the nature of your case, where you were arrested, and if you have a criminal history.

However, no matter what the circumstances of your DUI arrest, every case deserves an experienced DUI defense attorney. If you need to find an attorney, let 1 800 DUI Laws put you in touch with local defense lawyers who are waiting to hear from you!

Mike Ditka’s Son Arrested for Second DUI

Mark E. Ditka, the son of famed former Chicago Bears Coach Mike Ditka, was arrested for a DUI near his home in Deerfield, Illinois. This is his second DUI as he was arrested a little over a year ago for driving under the influence, as well.

Police pulled Ditka over early Sunday morning for driving erratically. Ditka already had a suspended license and police suspected that he may have been under the influence.  Though he refused a breathalyzer test, Ditka did perform a field sobriety test. Police searched his car and found Hydrocodone, a prescription medication.

The charges for a second DUI are significantly worse, especially if your license got suspended from your first DUI arrest. These charges can include mandatory jail and extremely expensive fines.

No matter what you’re going through, if you get arrested again for a DUI, it does not mean you should head into court without an attorney or that you don’t deserve legal representation.

You need an attorney on your side if you have been arrested for a second DUI or any type of drunk driving offense at all. Unsure where to begin? Let us help!
