One new California DUI / DWI law applies to individuals who are on probation for drunk driving. Drivers who are on probation for DUI / DWI in California are now prohibited from operating a motor vehicle when they have a blood alcohol content (BAC) of .01 percent or greater. Police may use a PAS test, or preliminary alcohol screening test, to determine the driver’s BAC. Drivers who are on probation for DUI / DWI in California are required to submit to a PAS test under California’s implied consent law.
A second new California law related to DUI / DWI pertains to driver’s license applications. Starting July 1, 2008, all applicants for a new driver’s license or a driver’s license renewal must acknowledge in writing that DUI / DWI that causes death can result in murder charges. This written admission will be used as evidence if the driver is later accused of causing death while driving under the influence.
