DUI Offenses

 
There are two main types of DUI offenses: misdemeanor DUI and felony DUI. Misdemeanor DUIs are given to individuals who drive under the influence and are pulled over by a police officer without any added infractions or grievance. As serious as drunk driving is, a misdemeanor DUI can be pled down to probation and fines with proper legal representation. 
 
A felony DUI is a bit more serious as it involves aggravated circumstances that elevate the misdemeanor charge into a felony. In some states, felony DUI is referred to as aggravated DUI. This type of DUI often involves circumstances beyond the normal drinking and driving situation. Aggravated DUIs are elevated DUI charges due to the severity of the situation or the blatant disregard of the law or safety of others by the drunk driver.
 
If a person with a history of misdemeanor DUI charges is brought before a court of law with another DUI charge, the judge may decide to allow an aggravated DUI charge to be allowed by the prosecution.  The same may apply if an individual has subsequent DUI charges in a short amount of time, like three drunken driving arrests in one month.
