What is DUI Entrapment?

Facts About DUI Entrapment

 
Entrapment is oftentimes difficult to prove in DUI cases due to a lack of evidence. This does not mean that entrapment in DUI cases never happen. Police officers may manipulate how a crime occurs so as to meet monthly DUI quotas. While this is not a frequent occurrence, DUI entrapment has been known to happen and DUI charges overturned due to police negligence.
 
DUI entrapment occurs when the following conditions are met:
 
  • The idea for committing the crime originated with the police or law enforcement officer, not from the person charged with the crime. 
  • Law enforcement officials subsequently persuaded the person into committing the crime. 
  • The person was not ready and willing to commit the crime before being entice or compelled to commit such actions by law enforcement officials.
