General Information:
Following
conviction, all offenders receive a mandatory alcohol
assessment to determine the nature and extent of their
alcohol problems.
The
assessment is conducted post-trial but pre-sentencing. The
court takes the results of the assessment into
consideration in final sentencing or subsequent offenses or serious accient cases.
Assessments
are conducted in some courts by a private agency at the direction of the court and are usually paid for by the offender's income.
For
first-time aggravated DWI offenders, the court must order
the offender to attend a DWI school or other rehabilitative services. The offender will be placed on probation and attend alcohol education or rehabilitation. Occasionally successful completion of programs can result in dismissal of the DWI charge although all DWI convictions are a permanent part of the driving record.
For subsequent offenders (2nd offense and up) there are a variety of required treatment programs statewide which are used by the courts. These programs include drug court in a few jurisdictions, private treatment programs and other state programs both in and outpatient based.
Treatment
is not mandatory for repeat and high BAC offenders.
Offenders
failing to comply with the terms of their program may not be
eligible for license reinstatement and may be returned to
the court for further action including mandatory jail time and additional programs.
New
Mexico does has treatment facilities that target the hardcore drunk driver, which may be publically funded or private.
BEWARE: Completing an alcohol program may not satisfy the Traffic Safety Bureau of the New Mexico DOT. That is just one reason why it is critical that you consult with a lawyer in your area that concentrates on DUI / DWI defense.
