In every Phoenix, Arizona DUI arrest, two separate cases are triggered.  There is a court case and a MVD case (Motor Vehicle Division).  As to the court case, you have undoubtedly received a notice to appear in a particular court on a particular date.  This first court appearance is called the arraignment.  This is the beginning of the formal court proceedings.

There is another case that you must be aware of as well:  The MVD case.  (This is sometimes referred to as the DMV case.)  In most Maricopa county drunk driving arrests, the arresting agency will take away your driver’s license and replace it with a pink and yellow piece of paper called the Admin Per Se Affidavit and a temporary license.  This piece of paper tells you that you have only 15 days from the date of your arrest to request a hearing from the MVD.  If you don’t request the MVD hearing within those 15 days, your license will be automatically suspended.  The length of the suspension will vary depending upon whether this is a first-offense driving while intoxicated charge or a subsequent DUI / DWI and whether a chemical test was taken or refused.

If you have been arrested for driving under the influence in Phoenix, or anywhere else in Maricopa county, contact a qualified attorney today.  Do not delay.  Your freedom and your driving privileges depend on it!
