Pennsylvania Expungement of criminal records
Expungement of criminal records can be a complex process, and the ability to clean up past criminal convictions depends upon many different factors. The law relating to expunging criminal convictions particularly a Pennsylvania DUI or DAI depends upon the specific conviction. PA DUI and DAI law does allow, in some cases, the expungement of first offense DUI and DAI ONLY. It is important to talk to a lawyer that is skilled in matters pertaining to expungement.
Pennsylvania DUI and DAI law includes the Accelerated Rehabilitative Disposition (ARD) - First Offenders Program ONLY. These records MAY be expunged. In some cases, the first time PA DUI / DAI offender may be eligible for the Accelerated Rehabilitative Disposition (ARD) Program. You are not eligible if, including but not limited to the following:
- Previously placed on the ARD program for a Pennsylvania DUI / DAI, or have been convicted of a DUI / DAI in the past ten (10) years
- Accident – not necessarily injuring or killing as a result of the DUI / DAI or drunk driving
- Passengers under the age of fourteen (14)
- Suspended, revoked, or invalid license – certain enumerated vehicle code offenses accompanying the DUI / DAI (designated by the District Attorney’s Office of that particular Pennsylvania county)
In addition, ARDs are unique to each and every county. The District Attorney of your specific county may have additional requirements or disqualifiers voiding the ARD program.
