4 Things That Will Happen During your WV DUI Trial

1. Prosecutors will present their case. Remember, in a DUI trial, the state has the burden of proof. Your defense lawyer has no obligation to prove you are innocent. The prosecution has to prove you are guilty.

2. Prosecution witnesses. The police officer who pulled you over will testify about your behavior, your BAC and other key pieces of evidence. There will also likely be an expert witness who testifies about chemical testing.

3. Defense case. Your lawyer will attempt to take apart the evidence that the state has against you – namely your chemical test results and your behavior during your arrest. 4. The verdict. A jury of your peers will hand down a verdict of guilty or not guilty. It is also possible that the jury will hang. That means the group couldn’t agree on a verdict. If this happens, it is likely your case will either be dismissed or a plea bargain will be offered to you.
