If you are facing a Colorado Springs DUI charge, you will need to get help. If you don't, you can expect to pay the price that includes losing your license, alcohol education classes and even jail time. First time offenders are not exempt from these types of penalties. But before you give up, you should make sure you have help fighting these charges. A skilled Colorado Springs DUI lawyer can make all the difference in the outcome of your case.

Remember, the state is responsible for proving that you are guilty beyond a reasonable doubt. Prosecutors will do that by using the testimony from the police officer who pulled you over. This is the star witness against you. That's why cops will do and say everything they can to get you to incriminate yourself at the scene if they believe that you are drunk. They will actually lie to you:

6 Lies Police Told Me During My Colorado Springs DUI Arrest

  1. You must answer everything I ask you. This is simply not true. In fact, you don't have to answer ANYTHING at all! It's really in your best interest to say quiet. Police will usually ask you something along the lines of "have you been drinking tonight?" The best answer to this question is NOT "I had a few beers." You should actually say "I would rather wait to speak to my lawyer before answering any of your questions." Plead the fifth!
  2. You have to take a field sobriety test. Field sobriety tests are completely voluntary. You do not have to take one. And you shouldn't. They are not reliable.
  3. If you don't get out of the car, you will go to jail. If a police officer says this to you, he is just trying to scare you. This is not true at all. You do not have to get out of your car. Police just want you to get out so they can observe your behavior and how you are handling yourself physically.
  4. You must give a breath or blood sample. Really, it's up to you whether or not you will submit to a chemical test. If you refuse to take a blood or breath test, you will be punished with a longer suspension on your license. A Colorado Springs DUI attorney may sometimes advise you that it's better to have a suspended license than a DUI on your record, especially if you have been convicted of DUI in the past. So if police tell you that you MUST take a chemical test, it's not true. You can refuse. But you must be willing to deal with the consequences.
  5. If your BAC is over the legal limit, you will be convicted of a Colorado Springs DUI. Just because you have been arrested and your BAC was over the legal limit, it does NOT mean you will be convicted! A skilled Colorado DUI lawyer will work to get your BAC results thrown out. Because police don't always perform these tests appropriately, you can get this evidence removed. Without your BAC results, prosecutors will have a very hard time proving you are guilty.
  6. You must let me search your vehicle. Just like a field sobriety test, you can politely refuse to have your car searched. There are absolutely no repercussions for refusing to have your vehicle searched. There is no benefit to you or your case. So if a cop asks, say no.

After being stopped for a possible DUI, police officers will work their hardest to get you to admit you are drunk and to gather the evidence to prove it. Don't help them! Heed the advice above. You have rights. Don't forget that. But remember, even if you have been arrested and you did allow police to search your car, or you submitted to a field sobriety test, you can still walk away from these charges. To have a chance at escaping punishment, you must hire an experienced Colorado Springs DUI lawyer immediately!
